KCC 195/2000
This case involved custody of children on divorce. A key issue was what laws should be applied when the husband was a Saudi citizen but had been stateless when they were married and how this impacted the custody of the daughters.
Background
A claimant filed a case against a defendant before the court. She requested the court to give her children the option to choose either her custody or her husband's custody. She said that she used to be the wife of the defendant and that he got married. She said that she wanted the children to be under her custody because the defendant had got married to another woman and he did not have the time for the children
The court ruled that the children should be put in the claimant's custody.
The defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling on the female children and upheld it otherwise.
