KCC 192/2002

This case involved whether a company with a registered commercial agency had the right to stop another company which did not have a registered agency selling the same products.

Background

A company filed a case against another company before the court. The company requested the court validate a preventive detention on the company's goods and order the company to pay 5001 Dinars as temporary compensation. The company said that it was the exclusive distributor of the goods of another company and that the second company had distributed items with the same trademark without approval and in a way that caused damage to them.

The court ruled that the second company should pay them 5464 Dinars.

The second company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case as well.
