This case involved a custody battle. Although there was a previous ruling granting custody to the wife the dispute could be heard again as she had moved with the children from Saudi to Kuwait.
Background
A man filed a case against his wife before the court. He requested the court to validate his custody of his children. He said that his wife left their home in Saudi Arabia and went to live in Kuwait.
The court ruled that the children should be under the father's custody.
The wife appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The wife appealed the ruling before the court of cassation. She said in her grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. She said that he had previously requested the court to get custody of the children but the court dismissed his request. She said that the case therefore was previously settled
