This case involved the rescission of a conveyancing contract. The down payment cheque had bounced and the full amount was not paid by the contracted date.
Background
A claimant filed a case against two defendants before the court. He requested the court to order the first defendant to pay him an amount of money. He said that he had bought a property from the first defendant and that the latter failed to commit to his obligations according to the contract and refused to register the property under his name.
The court ruled that the first defendant should pay the claimant 3000 Dinars.
The first defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
