KCC 185/2001

The initial dispute involved a claim against two companies for compensation by an employee who had been forced to retire because of a workplace injury. A key issue was where the case had been previously settled by another ruling.

Background

An employee made a complaint to the department of labour against two companies. He requested the two companies to pay him compensation of 266386 Dinars. He said that he was working for the first company and that he was referred to a retirement scheme due to a workplace injury that caused a disability. He said that the company had failed to pay him a compensation. The department referred the case to the court.

The first company filed a case before the court and requested the second company to pay the value of compensation.

The court ruled that the second company should pay the employee the mentioned compensation.

The second company and the employee appealed the ruling before the court of appeal. The court dismissed the employee's appeal and dismissed the appealed ruling.
