KCC 181/2001
The initial dispute involved a claim by an employee whose employer company had closed without paying his entitlements. A key point was whether the elementary ruling could be appealed as the case was filed against an irrelevant party.
Background
An employee made a complaint to the department of labour against a company. He said that he was working for the company and that it terminated its business without paying his entitlements. The department referred the case to the court.
The court ruled that the company should pay the employee 2511.520 Dinars.
The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case because it was filed against an irrelevant party.
The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law. He said that he maintained that the company's appeal was invalid because his requests did not exceed the final quorum of the elementary court but the court dismissed this defence.
