KCC 178/2001
This case involved a request by an employee for severance pay and pay in lieu of notice after termination of employment. The court had the authority to assess the reason for termination and it determined the employee had been running their own business in violation of the contract.
Background
An employee made a complaint to the department of labour against a company. He claimed that the company had dismissed him from his job and failed to pay his entitlements. He requested the company to pay him these entitlements including severance pay and the remaining value of the contract. The department referred the case to the court.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
