KCC 175/2001 issued on 30/09/2002

This case involved compensation for a workplace injury and the request to appoint an expert. A key point was whether the correct procedures had been followed in terms of filing with the department of labour first. It also considered if the appeal was acceptable as it had nothing to do with the matter under consideration,

Background

An employee filed a case against a company before the court. He requested the court to appoint a medical committee in order to check his rate of disability as a a result of work injury and to order the company to pay him a compensation.

The court dismissed the case.

Decision

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the court should not consider the case.
