Background

An employee filed a case against a company before the court. He requested the court to appoint a medical committee in order to check the rate of his disability as a a result of work injury and to order the company to pay him compensation.

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the court should not consider the case.

The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law. He said that the court had established its ruling on the grounds that he did not make his complaint to the department of labour first. He said that he did not make his complaint to the department but the court had referred to it.
