This case involved whether payments for a car should be part of the maintenance for a divorced woman.

Background

A woman filed a case against a previous husband before the court. She requested the court to order the husband to pay her expenses.

The court ruled that the previous husband should pay the woman 120 Dinars per month starting from 03/02/1999. The court ruled that previous husband should also pay 3000 Dinars so the woman could buy a car.

The woman and the previous husband appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the previous husband should pay 250 Dinars per month starting from 22/09/1999.

The previous husband appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. He said that the court ruled that he should pay the value of a car though this violated the law.
