This case involved the validity of an arbitration clause in a dispute involving an agency contract in Kuwait.
Background
A company filed a case against two companies before the court. The company requested the court to appoint an expert in order to estimate the compensation for damaged which had resulted from the termination of an agency contract and order them to pay the compensation accordingly. The company said that the two companies dismissed the agency contract signed with the company in the field of maritime shipping.
The court said that the consideration of the case did not fall under its jurisdiction due to the existence of an arbitration condition.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
