KCC 160/2001

The initial dispute involved whether two companies were liable to pay an employee compensation for a workplace injury. A key point was whether the ruling of the elementary court could be appealed.

Background

An employee made a complaint to the department of labour against two companies. He said that he was working for the first company and then he moved to work for the second company. He said that the two companies had failed to pay him compensation for a work injury. The department referred the case to the court.

The court ruled that the first company should pay the employee 259 Dinars and that the second company should pay him 1718 Dinars.

The first company appealed the ruling before the court of appeal. The court ruled that the company did not have the right to appeal the ruling due to the lack of a quorum.
