KCC 147/2001

The initial dispute involved compensation to an individual appointed to a company board which it was said had been improperly dismissed. A key point was whether the appellant had provided sufficient evidence that one of the judges had also been involved in a previous appeal.

Background

A claimant filed a case against a defendant and a company before the court. He requested the court to order the defendants to pay him temporary compensation of 5001 Dinars. He said that he was appointed to the board of the company. He said that the defendant then dismissed the board though he did not have the authorization to do so.

The court referred the case to the labour department in the court. The court dismissed the case because the claimant had failed to follow the legal proceedings when filing it.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
