KCC 144/2001

This case involved a subcontract arrangement where the project was cancelled and money owed. The key point was the evidential value of a photocopy showing the work was complete.

Background

A claimant filed a case against some companies before the court. He requested the court to appoint an expert in order to estimate the value of work he finished to the interest of the first companies and to order the companies to pay the value. He said that the second company assigned the first company to complete a construction project and that the first company assigned them to complete the project in exchange for a commission. He said that the third company, the owner of the project, cancelled the project because the second company had assigned its completion to the first company.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
