This case involved a payment order for a bounced cheque. It was not possible to claim the case was not filed within the statute of limitations for the first time before the court of cassation.
Background
A claimant obtained a payment order against a defendant ordering him to pay amount of money for the cheque which bounced.
The defendant made a plea against the order.
The court dismissed the plea.
The defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the order.
The claimant appealed the ruling before the court of cassation. The claimant said in his grounds of appeal that the appealed ruling had erred in the application of law. He said that he had maintained before the court that the plea made by the defendant should be dismissed because it was not filed within the legal deadline but the court dismissed this defence.
