KCC 134/2001
This case involved whether a Saudi woman should be considered a non-obedient wife as she had left home and not be paid an allowance by her husband. The law considered given the nationality of the couple whether Saudi or Kuwaiti law should be applied to this matter.
Background
A wife filed a case against her husband before the court. She requested the court to order her husband to pay her daily expenses. She said that he married her but he failed to commit to his obligations as a husband.
The court ruled that the husband should pay the wife 70 Dinars per month starting from 01/08/2000.
The husband appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The husband appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law. He said that the court ordered him to pay the monthly expenses of his wife though she illegally left home and therefore she did not deserve monthly expenses according to Saudi Law as they were both Saudis.
