This case involved the calculation of an employee's holiday entitlement based on service.

Background

An employee made a complaint to the department of labour against an employer. He said that he was working for the employer and that he refused to pay his entitlements. The department referred the case to the court.

The court ruled that the case should not be considered.

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the employer should pay the employee 7388 Dinars.

The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law. He said that the court calculated the value of his annual leave on the grounds that the employee had 14 days per year though he has 30 days per year as leave.
