KCC 120/2001

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 60000 Dinars. He said that he had bought a property from the defendant and that he paid the amount as part of the value. He said that the two parties agreed that the defendant would issue a power of attorney to him but she failed to do so.

The court ruled that the contract should be dismissed and that the defendant should pay the claimant the amount.

The defendant appealed the ruling before the court of appeal. The court requested the claimant to add two defendants to the case. The court requested the claimant to take the oath and he took it. The court upheld the appealed ruling.
