KCC 103/2001
Background
A claimant filed a case against a company and requested the court to order the company to pay an amount of money and legal interests. The claimant stated they supplied the company with goods but the latter refused to pay their remaining value.
The court ruled the company should pay the claimant 5162 Dinars and annual interest of 7%.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The company appealed the ruling before the court of cassation.
The court repealed the ruling and assigned an expert in order to review the cases documents.
The court stated the report of the expert had concluded that the company owed the claimant the mentioned amount.
The court upheld the appealed ruling.
