KCC 101/2001

A case involved a dispute between an employee and a company over the payment of her salaries.

Background

An employee filed a case against a company requesting that the court order it to pay her salaries.

The court rejected the case.

The employee appealed and the appeal court upheld the ruling.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as the court had rejected the case based on her not filing a complaint with the Labour Department, however she had filed a complaint in a previous case which had been dismissed.

The court held that this argument was invalid as the dismissal of previous cases entails the dismissal of the complaint before the Labour Department.

The court therefore dismissed the appeal.
