KCC 100/2001
This case involved the refusal to issue a death certificate. A key point was whether there was a proof of the man's nationality.
Background
A claimant filed a case against a defendant before the court. He said requested the court to order the Ministry of Health to issue a death certificate for his father. He said that a previous ruling had validated the death of his father but the ministry refused to issue the mentioned certificate.
The court ruled that the decision should be dismissed.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of the law and had insufficient evidence of causation. He said that Article 7 of Kuwait Law No. 36/1969 stipulated that the death notice should include the basic details about the dead person. He said that the claimant had failed to provide proof of the nationality of his father.
