KCC 9/2000

A case involved a dispute between claimants and defendants over their right in the management of a school.

Background

Claimants filed a case against defendants requesting that the court validate their right in the management of a school under a partnership contract.

The court rejected the case.

The claimants appealed and the appeal court upheld the ruling.

The claimants appealed by cassation.

Decision

Before the cassation court the claimants argued that the ruling had violated the law and had insufficient evidence of causation as the ownership of the school was a common one and thus all partners had a right in the management of it.

The court stated that this argument was invalid as the court has the authority to consider all aspects of case and evaluate the evidence before it to establish its ruling.

The court therefore dismissed the appeal.
