KCC 7/2000

A case involved a dispute between an employee and a company over the payment of his salaries and compensation for a work injury.

Background

An employee filed a case against a company requesting that the court order the company to pay his salaries and compensation for a work injury.

The court rejected the case.

The employee appealed and the appeal court ruled that the company pay the employee 1500 Dinars.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as the court had considered the injury a working one, however, the company had provided the court with documents confirming that the employee had been injured before commencing work with the company.

The court held that this argument was invalid as the court has the authority to consider all aspects of a case and evaluate the evidence so as to establish its ruling. The court stated that the documents and witness testimony revealed that the employee had been injured whilst working.

The court therefore dismissed the appeal.
