KCC 73/2000
Background
An employee filed a case against an association requesting that the court order it to pay his salaries.
The court ruled that the association pay the employee 726.910 Dinars.
The employee appealed and the appeal court ruled that the association pay the employee 4439 Dinars.
The association appealed by cassation.
Decision
Before the cassation court the association argued that the ruling had insufficient evidence of causation as it had maintained before the court that the employee did not deserve the value of holidays as he failed to complete one year in his job.
The court held that this argument was valid as the case documents revealed that the employee worked under a first contract for seven months and then six months under a second contract which meant that the service of the employee was not continuous.
The court therefore repealed the ruling.
