KCC 707/1999

This case involved a claim for a man who had died in a workplace accident against the insurance company which had insured these employees by his heirs. The insurance company had provided both the car insurance and the general employee insurance. It was wrongly argued this case which had involved death in a car accident did not involve labour rights so the heirs had been right to take the case against the company.

Background

The heirs of a deceased employee filed a case against a company and requested the court to order the company to pay them compensation and legal interest for the death of their father in a workplace accident. The heirs stated the company was the insurer of the employees at the time of the accident.

The court ruled that the company should pay the heirs 5100 Dinars and 7% annual interest.

The heirs appealed the ruling before the court of appeal. The court rejected the appeal and upheld the appealed ruling.
