Background
An employee filed a case against a company requesting that the court order it to pay his salaries.
The court ruled that the company pay the employee 3069.231 Dinars.
The employee appealed and the appeal court ruled that the company pay the employee 4320.82 Dinars.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had erred in the application of law and contradicted material documentary evidence as the court failed to order the company to pay compensation for the remaining period of the contract based on the contract renewal having an indefinite period, however, the parties had agreed that the contract renewal would be for a definite period.
The court held that this argument was valid as the contact stipulated that its period was one year and that its renewal would also be for one year.
The court therefore repealed the ruling.
