KCC 54/2001

A case involved a dispute between a claimant and defendant over the payment of compensation for a work injury.

A claimant filed a case against a defendant requesting that the court order the defendant to pay him compensation for damage resulting from a work injury.

The claimant appealed and the appeal court ruled that the defendant pay the claimant 2223.70 Dinars.

The defendant appealed by cassation.

Decision

Before the cassation court the defendant argued that the ruling had erred in the application of law and had insufficient evidence of causation as the court had miscalculated the value of compensation.

The court held that this argument was valid as the court had accurately determined the rules upon which the claimant should have been compensated, but then miscalculated the value of compensation.

The court therefore repealed the ruling.
