Background
An employee filed a case against defendants requesting that the court order them to pay compensation for a work injury.
The court ruled that the defendants pay the employee 22716 Dinars.
The defendants appealed and the appeal court ruled that the first defendant pay 22869 Dinars and rejected the case against the second defendant (insurance company).
The first defendant appealed by cassation.
Decision
Before the cassation court the first defendant argued that that the ruling was contradictory as the court had ruled that the second defendant was responsible for compensating the employee, but then denied this responsibility without explaining the legal basis of such a ruling.
The court held that this argument was invalid as the court concluded that the first defendant was responsible for the employee and thus was responsible for the payment of compensation to the employee.
The court therefore dismissed the appeal.
