Background

The company appealed and the appeal court ruled that the company pay the employee 4363.654 Dinars.

The employee and company appealed by cassation.

Decision

The cassation court dismissed the employee's appeal.

Before the cassation court the company argued that the ruling had contradicted material documentary evidence as it had provided the court with a document confirming that the employee had received his wage, but the court ruled that it pay this wage amount.

The court held that this argument was valid as the employer had provided the court with a document which confirmed that the employee had already received the wage in question.

The court therefore repealed the ruling.
