KCC 443/2000

This case involved the eviction from a leased property as a result of unpaid rent. It was wrongly argued on appeal the decision had been wrongly made as the correct court fees had not been paid because the case was reserved. This was incorrect as a court will not take action until the correct fees have been paid.

Background

A company filed a case against another company and requested the court to order the company to vacate a rented property and pay unpaid rent.

The court ruled that the second company should pay the first company 9100 Dinars and should leave the property.

The second company appealed the ruling before the court of appeal. The court rejected the appeal.

Decision

The second company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law and it had failed to pay the relevant fees because the case was reserved by the court in order to issue a ruling.
