KCC 273/2000

This case involved a claim for blood money for a man who had been killed by a mine. It was correctly argued the Ministry of Defence was responsible as they had not fenced off an area with mines.

The claimant filed a case against defendants and requested the court to order the defendants to pay them 10000 Dinars in blood money in addition to 25000 Dinars as compensation for the death of their father.

The court ruled that the third defendant should pay the claimant blood money of 10000 Dinars.

The claimants and the third defendant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

Decision

The claimants appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law because they had maintained before the court that the Ministry of Defence should bear the responsibility for their father's death because the Ministry had not put a fence around the area with the mines.
