KCC 25/2001

The original case involved a claim by an employee for their dues. It was wrongly argued the committee of experts was not allowed to appoint another expert without the authority of the court.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay their dues.

The court ruled that the company should pay the employee 3823.985 Dinars.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling was illegal because they had maintained before the court that the committee of experts had not referred the case to the court but assigned a new expert to review the case documents without the court's authorization.

The court stated this argument was invalid because Article 8 of Kuwait Law No. 40/1980 stipulated that the body which assigns the expert to do his task has the right to assign another expert.

The court dismissed the appeal.
