Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay compensation for a workplace injury. The department referred the case to the court.

The company filed a case against an insurance company and requested the court to order the insurance company to pay the value of compensation.

The court ruled that the company should pay the employee 7070 Dinars and the insurance company should pay the company the amount.

The insurance company appealed the ruling before the court of appeal. The court abandoned the appealed ruling in regards to the second case and upheld the appealed ruling in other points.

Decision

The company appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had erred in the application of law and the court had ignored its defence on the insurance company although it was a substantial one.
