Background
The heirs of a deceased employee filed a case against a company requesting that the court order the company to pay compensation for the death of their father at work and his dues.
The court ruled that the company pay the heirs 10000 Dinars.
The company appealed and the appeal court upheld the ruling.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had erred in the application of law as he had provided the court with evidence that the employee did not die during the course of his work.
The court held that this argument was valid as the case documents revealed that the injury which caused the death of the employee had not taken place during working hours.
The court therefore repealed the ruling.
