Background
An employee made a complaint against a company and other defendants and requested the Labour Department to order them to pay his dues. The department referred the case to the court.
The court ruled that the defendants should pay the employee $62570.61 in addition to 2000 Dinars in temporary compensation.
The defendants appealed the ruling before the court of appeal. The court abandoned the appealed ruling and refused to consider the case.
Decision
The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and stated that the court had refused to consider the case based on the argument that the employee had filed the case one year after the termination of the contract although the case documents revealed a working relationship still existed.
