A case involved a dispute between an employee and a company over the payment of his dues.

Background

An employee filed a case against a company requesting that the court order the company to pay his dues.

The court ruled that the company pay the employee 8885.333 Dinars.

The company appealed and the appeal court upheld the ruling.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as the court had miscalculated the value of compensation the employee deserved for a work injury.

The court held that this argument was valid as Article 65 of Kuwait Law No. 38/1964 stipulated that if an employee was injured at work, he deserved compensation according the appendix issued by the Minister of Labour and Social Affairs.

The court therefore repealed the ruling.
