KCC 83/1999

A case involved a dispute between a claimant and the owner of a company over the payment of compensation for a work injury.

Background

A claimant filed a case against the owner of a company requesting that the court order him to pay him compensation for damage resulting from a work injury.

The court ruled that the owner pay the claimant 8461.200 Dinars.

The claimant and owner appealed and the appeal court upheld the ruling.

The owner appealed by cassation.

Decision

Before the cassation court the owner argued that the ruling had erred in the application of law as the claimant had filed the case against him as owner of the company instead of filing the case against him in person.

The court held that this argument was invalid as the case documents revealed that the claimant had filed his case against the defendant as owner of the company and thus had filed his case against a relevant party.

The court therefore dismissed the appeal.
