A case involved a dispute between a company and the Kuwait Municipality over an amount of money.

Background

A company filed a case against the Kuwait Municipality requesting that the court order it to pay an amount of money. The company stated that the municipality owed it this amount.

The municipality filed a case against the company requesting that the court order it to pay an amount of money as the company had failed to commit to its obligations under contract.

The court ruled that the municipality pay the company 26593.466 Dinars and rejected the case made by the municipality.

The company and the municipality appealed and the appeal court ruled that the municipality also pay annual interest at 7%.

The municipality appealed by cassation.

Decision

The Public Prosecution argued that the appeal should be dismissed.

The court held that this argument was valid as the appeal before the court of cassation should be signed by a member of the Department of Fatwa and Legislation if the appeal is filed by a governmental or public body.

The court therefore dismissed the appeal.
