KCC 3&4/2000

This case involved a request by an employee for entitlements on termination and compensation for a workplace injury. The employee had failed to prove the injury was work related and a settlement had been signed between the parties so no money was owed.

Background

An employee filed a case against a company before the court. He requested the court to order the company to pay him his entitlements and compensation for damage which had resulted from a workplace injury.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee an amount of money.

The employee and the company appealed the ruling before the court of cassation.

Decision

Appeal No. 3/2000:

The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the injury of the employee was not related to his work at the company.
