KCC 275/1999

This case involved a claim for compensation and blood money for a man who had been killed in a bomb explosion. The Ministry of Defence were liable as they had not properly cleaned up weapons left over from the war.

Background

The heirs of a deceased man filed a case against two defendants and requested the court to order the defendants to pay them blood money of 10000 Dinars and compensation of 10000 Dinars for the death of their father as a result of the explosion of a bomb which had been a remnants of the war.

The court ruled that the first defendant should pay the claimants 17000 Dinars.

The first defendant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

The claimants appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law because the state should bear the responsibility for protecting the lives of the people.
