This case involved a claim by a company against the manager of a bureau and the request that work they had completed under a contract be reviewed by an expert and reasons for delay and compensation due determined. The court ruled an amount plus legal interest should be awarded to the company. At the court of cassation the company appealed on the basis the manager had refused to pay legal interest from the date the case was filed. This was treated as a new request which had not been introduced by the claimant at the elementary court so the appeal was dismissed.

Background

A company filed a case against the manager of a bureau and requested the court to appoint an expert to review the works they had completed according to a contract and determine the reasons for delay and the value of compensation.

The court ruled that the manager of the bureau should pay the company 20528.980 Dinars.

The company and the defendant appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the manager should pay the company 11445.535 Dinars and 7% annual interest.
