KCC 210/2000

This case involved freedom of the press and whether an article had been intended to insult or achieve public interest.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him compensation for damage which had resulted from publishing an article insulting him.

The court ruled that the defendant should pay the claimant 2000 Dinars.

The claimant and the defendant appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.

The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law. He said that the freedom of opinion was protected by the constitution as the aim of publishing was to achieve a public interest. He said that he did not intend to insult the claimant.
