KCC 153/1999

A case involved a dispute between an employee and a bank over the payment of compensation for unjustified dismissal.

The employee appealed and the appeal court upheld the ruling.

Decision

Before the cassation court the employee argued that the ruling had insufficient evidence of causation as the court had rejected her case based on the bank not making a mistake by dismissing her as the contract had an indefinite period, however, the bank had approved her resignation one month later thus depriving her from applying for another job.

The court held that this argument was invalid as the employee should deserve compensation for unjustified dismissal if the contract has a definite period.

The court therefore dismissed the appeal.
