KCC 128/1999

This case involved a claim for severance pay by an employee. The court had been correct to reject the case on the grounds it had been filed outside the statute of limitations despite the fact the employer had endorsed their rights.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay his dues. The department referred the case to the court.

The court decided not to consider the case on severance pay and rejected the case on other points.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had contradictions of material documentary evidence because the court had decided not to consider the case based on the argument that the employee had filed it one year after the termination of the contract although this period had been interrupted when the company had endorsed his labour rights.
