Background
The heirs of a deceased employee filed a case against the owner of a company requesting that the court order the owner to pay compensation for the death of their father at work.
The court ruled that the owner pay the heirs 14089.628 Dinars.
The owner appealed and the appeal court upheld the ruling.
The owner appealed by cassation.
Decision
Before the cassation court the owner argued that the ruling had insufficient evidence of causation as he had provided the court with evidence that the employee did not die during the course of his work.
The court held that this argument was invalid as the court had concluded from the case documents that the injury which caused the death of the employee had taken place during working hours.
The court therefore dismissed the appeal.
