KCC 11/2000

This case involved a claim for compensation and blood money by the heirs of a man who had died in a workplace accident. It was wrongly argued the compensation should be linked to his salary.

Background

The heirs of an employee made a complaint against the company before the Labour Department and requested the department to order the company to pay them blood money as their father had died while at work. The department referred the case to the court.

The court ruled the company should pay the first three heirs 10000 Dinars in blood money plus 7000 Dinars in compensation for the first two heirs and 45000 Dinars for the third heir in compensation and 5000 Dinars to the remaining heirs.

The company and the heirs appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had contradictions of material documentary evidence because the court had overestimated the value of the compensation as the employee used to receive a salary of 70 Dinars per month.
