Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court ruled that the company pay the employee 2378.991 Dinars.
The company and employee appealed and the appeal court upheld the ruling.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had erred in the application of law as the court had calculated the value of holidays by dividing the monthly wage based on 26 days instead of 30 as the employee received a full wage for a weekend.
The court stated that this argument was valid as the working contract between the parties stipulated that the value of holidays should be calculated by dividing the monthly wage based on 30 days.
The court therefore repealed the ruling.
