Background

An employee filed a case against a company requesting that the court order it to pay his salaries.

The company filed a case against the employee requesting that the court order him to pay 280312 Dinars.

The court ruled that the company pay the employee 24149.034 Dinars and rejected the case made by the company.

The company appealed and the appeal court upheld the ruling.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as the elementary ruling upheld the argument that the case should not be rejected based on the company having endorsed that it owed the mentioned amount to the employee, however, it was the employee that made this endorsement.
