KCC 34/1998
Background
An employee made a complaint against an employer and requested the Labour Department to order an employer pay his dues. The department referred the case to the court.
The court ruled that the heirs of the employer should pay the employee 21108.820 Dinars.
The heirs of the employer appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the first defendant and all other defendants except the third and the fourth should pay the employee 13375.716 Dinars.
Decision
The first defendant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had violated the law and the court had ordered him to pay the appeal fees although the bureau he represented was exempted from the payment of the fees according to the relevant laws.
