KCC 168/1998, 171/1998

This case involved a claim for unpaid salary by an employee. The employer correctly argued the employee had been paid all their dues because there was a settlement they had signed. As the dispute had been settled the employee could not appeal.

Background

An employee made a complaint against an employer before the Labour Department and requested the department order the employer to pay his salary. The department referred the case to the court.

The court rejected the case.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the employer should pay the employee 2864.289 Dinars in addition to 9106.403 Dinars.

The employee and the employer appealed the ruling before the court of appeal.

Decision

In Appeal No. 168/1998: The employer stated the ruling had erred in the application of law because the employee had already received is his financial dues and he had provided the court with a final settlement signed by the employee.

The court said that this argument was valid.

The court repealed the ruling.
